Cookie Policy

KVK 93377797  ·  Effective: May 2026  ·  Houten, NL

01

Introduction

This Cookie Policy explains how FNDMNTL Basketball ("We," "Us," "Our"), registered in the Netherlands under KVK 93377797, uses cookies and similar tracking technologies on our websites and digital platforms.

It outlines what cookies are, which types we use, the legal basis for each, how you can manage your preferences, and your rights. This policy should be read alongside our Privacy Policy.

We comply with the General Data Protection Regulation (GDPR), the Dutch GDPR Implementation Act (UAVG), the Dutch Telecommunications Act (Telecommunicatiewet), and the Autoriteit Persoonsgegevens cookie guidelines as updated in November 2025.

02

What Are Cookies?

Cookies are small text files placed on your device when you visit a website. They allow websites to remember information about your visit — such as your preferences, session data, or browsing behaviour — to improve functionality and measure performance.

Similar technologies include pixels (invisible image tags used for tracking), local storage (browser-side data storage), and session identifiers. Where we refer to "cookies" in this policy, this includes all such equivalent technologies unless otherwise stated.

03

Types of Cookies We Use Updated

We use the following categories of cookies. Consent is required for all non-essential categories before placement.

We no longer reference Hotjar as a third-party analytics provider. If this changes, this policy will be updated accordingly with at least 14 days' prior notice.
04

Legal Basis for Using Cookies Updated

We process cookie data under the following legal grounds in accordance with Article 6 GDPR and the Dutch Telecommunicatiewet:

  • Strictly necessary cookies — Exempt from consent requirements under Article 11.7a Telecommunicatiewet. No legal basis under GDPR is required as these cookies do not involve personal data processing beyond what is technically necessary.
  • Functional, analytical, and marketing cookies — Require your freely given, specific, informed, and unambiguous consent (Article 6(1)(a) GDPR) prior to placement. Consent is collected via our cookie banner. You may withdraw consent at any time.
We do not rely on "legitimate interest" as a legal basis for analytical or marketing cookies. This aligns with the Autoriteit Persoonsgegevens position that legitimate interest cannot be used to justify non-essential cookie placement without consent.
05

06

Google Consent Mode v2 Added

From March 2024, Google requires all websites using Google Ads or Google Analytics in the EU/EEA to implement Consent Mode v2. We have fully adopted this standard.

Consent Mode v2 works as follows:

  • If you accept analytical and/or marketing cookies, Google services function normally and collect full measurement data.
  • If you decline or do not respond, Google services operate in a restricted mode — no cookies are placed, no personal data is collected, and only aggregated, non-identifiable modelled data may be used by Google for reporting purposes.
  • Your consent signal is passed to Google in real time via the consent API. We do not allow Google tags to fire before a valid consent signal is received.
IP anonymisation is enabled for all Google Analytics requests originating from the EU/EEA. No full IP addresses are stored or transmitted.
07

How We Use Cookies

We use cookies to:

  • Ensure website security, stability, and performance
  • Remember your cookie consent choices and preferences
  • Analyse website traffic and user behaviour to improve our services
  • Deliver and measure targeted advertising where you have given consent
  • Enable social media content and functionality where embedded on our pages

We do not use cookies to build personal profiles, make automated decisions about you, or share data with parties outside those listed in this policy and our Privacy Policy.

08

Managing & Disabling Cookies Updated

You have full control over non-essential cookies. You can manage your preferences through any of the following methods:

Cookie Banner Adjust your preferences at any time via the cookie settings panel accessible at the bottom of every page on our website.
Withdraw Consent You can withdraw previously given consent at any time. This will not affect the lawfulness of processing carried out before withdrawal.
Browser Settings Block or delete cookies via your browser preferences. Note: blocking all cookies may affect website functionality.
Third-Party Opt-Out Tools Google: adssettings.google.com
Meta: facebook.com/privacy/policies/cookies
Disabling strictly necessary cookies is not possible as they are required for the website to function. Disabling other categories will not prevent you from accessing our content or services.
09

Third-Party Cookies & Data Sharing

We partner with the following third-party services which may set cookies on our website. Each is bound by their own privacy and cookie policies:

  • Google Analytics (GA4) — User behaviour tracking and traffic analysis. Google Privacy Policy
  • Meta (Facebook Pixel) — Ad targeting and conversion tracking. Meta Cookie Policy
  • Payment Processors — Secure transaction handling. These services may set session-level cookies strictly necessary for payment processing.
  • Social Media Platforms — Embedded content from Instagram, YouTube, and Facebook may set cookies when you interact with that content, subject to your consent.

We do not sell cookie data to third parties and do not allow third-party providers to use data collected via our website for their own purposes beyond those described above.

10

Data Retention Updated

Cookie retention periods vary by type. Specific retention periods for each cookie are listed in the Cookie Inventory above. As a general guide:

  • Session cookies — Deleted automatically when you close your browser
  • Consent preference cookies — 12 months, after which we will ask for your consent again
  • Analytical cookies — Maximum 24 months (Google Analytics GA4)
  • Marketing cookies — Maximum 90 days (Facebook Pixel)

When cookies expire or are deleted, any associated data held by third-party providers is governed by their own retention policies. We encourage you to review these directly.

11

Updates to This Policy Updated

We may update this Cookie Policy to reflect changes in the cookies we use, applicable law, or regulatory guidance. The current effective date is always shown at the top of this page.

For material changes — such as introducing a new category of cookies, adding new third-party providers, or changing the legal basis for existing cookies — we will notify active users with at least 14 days' advance notice before the change takes effect, and will request renewed consent where required.

For minor updates (e.g., correcting cookie names, adjusting retention periods within the same category), we will update the effective date and publish the revised policy without prior notice.
